The terms of sale of the Yumki Pro plan on the yumki.app website, including the 14-day refund.

1. Seller and scope

These terms and conditions of sale govern the sale of the Yumki Pro plan on the website https://yumki.app. The seller is Nundia LLC, 1207 Delaware Avenue, 5052, Wilmington, DE 19806, United States, reachable at [email protected].

They supplement the Terms of Service. The customer accepts them before paying; the version in force on the date of the order applies.

Purchases made in the iOS app are sold and billed by Apple and are governed by section 9.

2. Plans

Free
No payment. Each month: one week of menus composed, 3 receipts read and 10 messages to the assistant.
Pro
Removes these monthly limits, for a household of at most five people: the holder and four relatives they invite.

On the website, the Pro plan is purchased in one of the following forms:

Monthly
€7.90 per month. Subscription renewed automatically every month.
Annual
€34.90 per year. Subscription renewed automatically every year.

The features of the chosen plan are presented before payment.

A lifetime plan, paid once, is offered only in the iOS app: it is sold by Apple and governed by section 9.

3. Prices

Prices are stated in euros, all taxes included. Nothing is added to them at the time of payment: the amount shown before payment is the amount charged.

If the customer's means of payment is denominated in another currency, the conversion and any related fees are a matter for the institution that issued it.

A price change does not apply to a period already paid for. It applies to an ongoing subscription only from a renewal, after the customer has been informed by email early enough to cancel before that renewal.

4. Ordering

Orders are placed on the website, from a Yumki account, through the following steps:

  • the customer chooses the plan on the website; the notice below the button that leads to payment links to these terms and conditions of sale, which the customer accepts by continuing the order;
  • on Stripe's payment page, the customer reviews the order summary, which states the plan, its total price, its billing period and its automatic renewal, then confirms the order using a button that clearly indicates that the order involves an obligation to pay;
  • the order is confirmed to the customer on screen.

The contract is concluded when the payment is confirmed.

5. Payment

Payment is made through Stripe, on its own pages, using the payment methods they offer. Payment details are entered at Stripe: Nundia LLC does not store them and keeps only references to them.

The price of a subscription is charged when the order is placed, then at the start of each new period.

6. Term, renewal and cancellation

The monthly and annual subscriptions take effect when the order is confirmed. They renew automatically at the end of each period, for a period of the same length, until they are cancelled.

The customer may cancel their subscription at any time from the billing settings of their account. Cancellation takes effect at the end of the paid period: access to Pro is maintained until that date, after which the account returns to the Free plan.

7. 14-day refund

Any payment made on the website, for the monthly or the annual subscription, is refunded in full on simple request sent to [email protected] no later than the fourteenth day following the day of payment. No reason is required.

This commitment applies to every payment made on the website, including the payment of a renewal. It covers the statutory right of withdrawal described in section 8 and goes beyond it: it also applies to renewals, and the refund is always made in full, with no deduction for the period already used.

To make processing easier, the request is preferably sent from the account's email address. The refund is made without undue delay and no later than 14 days after the request is received, to the means of payment used for the purchase, at no cost to the customer.

The refund ends the subscription: it is cancelled immediately, and the account returns to the Free plan.

8. Statutory right of withdrawal

A customer acting as a consumer has the right to withdraw within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which the contract is concluded.

To exercise this right, the customer informs Nundia LLC of the decision to withdraw by an unequivocal statement, by email to [email protected] or by post to 1207 Delaware Avenue, 5052, Wilmington, DE 19806, United States, stating their name, geographical address and email address. The customer may use the model withdrawal form in section 14, but this is not obligatory. To meet the withdrawal deadline, it is sufficient for the customer to send the decision before the withdrawal period has expired.

If the customer withdraws, Nundia LLC reimburses all payments received under the contract without undue delay and no later than 14 days after being informed of the decision. The reimbursement is made using the same means of payment as the customer used for the initial transaction, unless the customer has expressly agreed otherwise, and at no cost to the customer.

Where the customer has requested that the service begin during the withdrawal period, the law allows the seller to retain an amount proportionate to the service already provided. Nundia LLC waives this deduction: the refund is always made in full.

9. Purchases in the iOS app

In the iOS app, the Pro plan is sold and billed by Apple, under Apple's terms. The price, currency and taxes of these purchases are those shown by the App Store at the time of purchase.

Renewal, cancellation and refunds of these purchases are managed in the settings of the customer's Apple account, and any refund is requested from Apple. The refund commitment in section 7 applies only to payments made on the website.

Deleting the Yumki account does not end a subscription managed by Apple.

10. Changes to the service

Nundia LLC may change the service, in particular to improve it, to adapt it to technical or legal developments, or to keep it secure, at no additional cost to the customer.

Where a change has a negative impact, which is not minor, on the customer's access to or use of the service, Nundia LLC informs the customer in advance by email. The customer may then terminate the contract free of charge within 30 days of that information or, if later, of the change, and obtain a refund of the part of the price paid in advance for the period that remained.

11. Statutory guarantees and liability

A customer acting as a consumer benefits from the statutory guarantees granted by the law of their country of residence, in particular, in the European Union, the legal guarantee of conformity for digital content and services, which covers the entire period during which the service is supplied. Nothing in these terms affects them.

In all other respects, the liability of Nundia LLC is governed by the Terms of Service, which neither exclude nor limit it where the law prohibits doing so.

12. Complaints

Any complaint about an order, a payment or a refund should be sent to [email protected], stating the account's email address and the date of the payment concerned.

13. Governing law and jurisdiction

These terms are governed by the law of the State of Delaware (United States). This choice does not deprive a customer acting as a consumer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.

The complaint described in section 12 is optional. Failing an amicable solution, the courts of the State of Delaware have jurisdiction. A customer acting as a consumer nevertheless retains the right to bring proceedings before the courts of their country of residence, and may be sued only before those courts where the law of that country so provides.
