1. Purpose and acceptance
These terms of service govern access to and use of the Yumki service, on the website https://yumki.app and in the iOS app “Yumki”. The service is published by Nundia LLC, 1207 Delaware Avenue, 5052, Wilmington, DE 19806, United States, reachable at [email protected].
Creating an account constitutes acceptance of these terms. The purchase of the Pro plan on the website is also governed by the Terms and Conditions of Sale, and the processing of personal data is described in the Privacy Policy.
2. The service
Yumki helps a household organise its meals. In particular, the service offers:
- the week's dinner menus, composed from a recipe collection;
- recipe cards, a shopping list and a pantry;
- receipt reading;
- recipe import from a link, a photo or a video;
- a conversational assistant and voice input;
- an estimate of the cost of groceries by country and by retailer.
The service is available in French, English and Spanish. It is offered in France, Belgium, Switzerland, Spain, Canada, the United States and Australia. Price estimates depend on the public data available for each country, and may be missing for some products or some countries. Using the service requires an internet connection.
3. Account
The service is reserved for people aged 18 or over. An account is created with an email address and a password, or by signing in with Apple or with Google.
The user provides accurate information and keeps it up to date. The account is personal: the user keeps their credentials confidential and shares them with no one, including within their household. The user may enable two-factor authentication. The user reports to [email protected] without delay any use of their account that they have not authorised.
4. Household
Yumki organises meals by household. With the Pro plan, the holder of the plan may invite up to four relatives to join their household, which then has at most five people. Invitations are sent by email. Each invited relative must be aged 18 or over and uses their own account.
Children in the household have no account: the meal profile only records how many there are.
The holder decides on invitations. Each member uses the household space with respect for the other members and for these terms.
5. Plans
The Free plan allows, each month, one week of menus to be composed, 3 receipts to be read and 10 messages to be sent to the assistant. The paid Pro plan removes these limits for a household of at most five people.
The Pro plan purchased on the website is governed by the Terms and Conditions of Sale. When purchased in the iOS app, it is sold and billed by Apple, under Apple's terms.
6. Rules of use
The user uses the service in accordance with the law and these terms. In particular, the user shall not:
- upload or share content that is unlawful or that infringes the rights of others, in particular intellectual property or privacy;
- use another person's account or impersonate someone else;
- undermine the security or proper functioning of the service, in particular by attempting to access an account, data or systems without authorisation;
- extract data from the service by automated means, or circumvent usage or request limits;
- resell access to the service or make it available to third parties outside their household;
- decompile or disassemble the service, except to the extent permitted by law;
- use the assistant or the other artificial intelligence features to produce unlawful content.
Request limits protect the service against abuse.
7. User content
The user retains the rights they hold in the content they submit to the service, such as their recipes, photos, receipts, lists and messages to the assistant.
The user grants Nundia LLC, free of charge, on a non-exclusive basis and worldwide, the right to host, reproduce, process, technically adapt and display this content, for the user and for the members of their household, directly or through its providers, only to the extent necessary for the service to operate. This licence ends when the content or the account is deleted.
The user submits and imports only content they have the right to use. Recipes the user imports remain reserved for the private use of the user and their household.
8. Artificial intelligence features
The assistant, the reading of receipts and food photos, recipe import, menu composition, the illustration of composed recipes and the transcription of voice and of the sound of imported videos rely on artificial intelligence models supplied by third-party providers, named in the Privacy Policy. The necessary content is sent to them only with the user's explicit consent, requested before first use and revocable at any time in Settings, under “AI services”.
Results produced by artificial intelligence may be inaccurate or incomplete: a misread receipt, an ingredient missing from an imported recipe, a wrong quantity, duration or price, an illustration that does not look like the dish. The user checks these results before relying on them.
9. Allergies, health and food
The service takes into account the allergies, diet and excluded foods the user declares, but it cannot guarantee that a menu, a recipe or a product contains none of the ingredients concerned: a recipe may be incomplete, information may be misread, and the composition of a product may change.
The user must therefore always personally check the labels of the products they buy and the presence of allergens before preparing or serving a dish, especially when someone in the household has an allergy or an intolerance.
Yumki provides neither medical advice nor nutritional advice. Its suggestions do not replace the advice of a doctor, an allergist or a dietitian, who should be consulted for any health question or for a prescribed diet.
10. Price estimates
The grocery costs displayed are indicative estimates. They are based on public sources: official statistical institutes, community price records and published consumer surveys. They are neither a quote nor an offer from any retailer, and the price paid in store may differ.
11. Availability and changes to the service
Nundia LLC endeavours to keep the service available at all times, without being able to guarantee it: the service may be interrupted for maintenance, updates, incidents or external causes. Nundia LLC endeavours to limit the duration of these interruptions.
The service evolves: features may be added, modified or withdrawn. For the Pro plan purchased on the website, the Terms and Conditions of Sale set out the customer's rights when a change has a negative impact on their access to or use of the service.
12. Suspension and termination
In the event of a serious or repeated breach of these terms, where the user does not meet the age requirement, or where the security of the service, its users or third parties so requires, Nundia LLC may suspend access to the account or close it. The measure is proportionate to its cause. Except in an emergency or where required by law, the user is informed in advance by email, with the reasons for the measure, and may submit observations to [email protected].
13. Account deletion
The user may delete their account in the settings. Deletion is final: the account data is erased, then stored files are purged, as described in the Privacy Policy.
While a subscription taken out on the website is running, including until the end of the paid period after it has been cancelled, the account cannot be deleted from the settings; a user who wants immediate deletion requests it at [email protected]. Deleting the Yumki account does not end a subscription managed by Apple, which is cancelled in the settings of the Apple account.
14. Liability
Nundia LLC provides the service with due care and is liable, under the conditions provided for by applicable law, for damage caused by a failure to perform its obligations.
To the extent permitted by law, it is not liable where the damage results from use of the service contrary to these terms or from a case of force majeure.
Nothing in these terms excludes or limits the liability of Nundia LLC in the event of intentional misconduct, gross negligence or personal injury, or where the law prohibits doing so. Nothing in them deprives consumers of the rights and guarantees granted to them by the law of their country of residence.
15. Changes to these terms
Nundia LLC may amend these terms to reflect changes in the service or in the law. The version in force is published on the website with its date. Any significant change is announced to the user by email or in the service before it takes effect. A user who does not accept it may, before that date, delete their account and, if subscribed, cancel their subscription.
16. Governing law and disputes
These terms are governed by the law of the State of Delaware (United States). This choice does not deprive consumers of the protection afforded to them by the mandatory provisions of the law of their country of habitual residence.
The user may send a complaint to [email protected] in order to seek an amicable solution; this step is optional. Failing an amicable solution, the courts of the State of Delaware have jurisdiction. Consumers nevertheless retain the right to bring proceedings before the courts of their country of residence, and may be sued only before those courts where the law of that country so provides.
